EB-1A Strategy

Application Strategy

How to build a persuasive EB-1A petition from the ground up

01

Phase 1: Eligibility Assessment

Before filing, rigorously audit your credentials against all 10 criteria. The goal is not just to identify which 3 you meet — it is to identify which 3-5 you can document convincingly.

Which criteria can you document most thoroughly?

Are there gaps in evidence that could be addressed now?

How does your profile compare to approved cases in your field?

02

Phase 2: Evidence Architecture

Each criterion needs a dedicated evidence package — not just a checklist item. Think of each as a mini-brief: primary documents, context, and expert corroboration.

CriterionPrimary EvidenceSupporting Evidence
Awards (C1)Award certificate + selection criteriaNews coverage, award committee letter
Judging (C4)Invitation letters from journals/panelsList of reviewed papers, editor confirmation
Contributions (C5)Publications showing your influenceIndependent citations, adoption in industry
Leading Role (C8)Org chart, project scopeCompany revenue/scale, team size
03

Phase 3: Expert Recommendation Letters

Letters are the connective tissue of your petition. A great letter does three things: (1) establishes the writer's authority, (2) describes your specific contributions, and (3) explains why you are extraordinary — not just good.

Letter DOs

  • Independent experts (not supervisors)
  • Specific technical language
  • Comparison to peers in field
  • Explicit national importance connection

Letter DON'Ts

  • Generic praise without specifics
  • Letters from direct supervisors only
  • Focus on future potential
  • Duplicated boilerplate language
04

Phase 4: The Petition Brief

The cover letter / attorney brief is your most important document. It organizes all evidence into a coherent narrative, pre-addresses potential objections, and guides the adjudicator through your case.

1

Introduction: Who you are and why you qualify

2

Criterion-by-criterion analysis with evidence citations

3

Final merits argument: the big picture

4

Conclusion: why waiving labor certification serves national interest

Be Prepared

Preparing for RFE

Even strong petitions sometimes receive RFEs. Common triggers include: insufficient evidence for claimed criteria, weak expert letters, or adjudicator unfamiliarity with your field. Having a response strategy ready before filing reduces stress.

Common RFE Triggers

  • Request for additional evidence on award prestige
  • Challenge to organizational "distinguished" status
  • Questioning whether your role was truly "leading/critical"
  • Insufficient comparator salary data

Response deadline: 87 days
